Learn About the Process From an Atlanta, Georgia Divorce Attorney

If you are involved or about to be involved in a divorce in Atlanta or anywhere in Georgia, you are probably wondering what the process looks like.

What Are Grounds for Divorce in Georgia?

Georgia recognizes two main types of divorce: fault and no-fault.

In a no-fault divorce, neither partner has performed any specific action or shown any specific behavior that would be considered grounds for a fault-ground divorce. In a no-fault divorce, the ground is “irreconcilable differences with no hope for reconciliation.”

In a fault-ground divorce, one party’s actions or behaviors are the primary cause for the breakdown in the marriage. Georgia recognizes 11 grounds for a fault-ground divorce:

  1. Adultery
  2. Habitual intoxication/addiction
  3. Mental incapacity at time of marriage (you were mentally unfit to agree to the marriage when you entered into it)
  4. The marriage was based on fraud (your spouse lied to you in order to secure your hand in marriage)
  5. The wife became pregnant by another man prior to the marriage and the husband was unaware
  6. The husband was impotent at the time of marriage and did not inform the wife
  7. Cruel treatment, including physical, sexual, or emotional abuse
  8. Intermarriage between two individuals of close blood (you knowingly or unwittingly married a close relation)
  9. One partner is convicted of a “crime of moral turpitude” and is sentenced to incarceration of two or more years
  10. One partner is diagnosed with an incurable mental illness that typically requires institutionalization
  11. Abandonment, or willful desertion

Initial Consultation

Whether your divorce is the result of one spouse’s inappropriate behavior (adultery, physical/verbal/emotional abuse, neglect, or substance abuse, etc.) or is a no-fault divorce, your first step is to call the team at Rubin Family Law to schedule an initial consultation with a divorce attorney. In this meeting, we will learn more about you and your situation and help you understand your options and next steps.

Filing

The divorce process starts when one party files a complaint with the appropriate court. The complaint must specify a reason for the divorce, even if the reason is simply “irreconcilable differences.” Regardless of the nature of the divorce, one party will be the petitioner and one the respondent. Once the complaint is filed and the respondent responds to the complaint, the proceedings can begin.

Determining the Issues

The primary challenge in a divorce is finding agreement between the two parties. Unless you and your spouse have already settled these issues prior to filing, there is likely to be some disagreement to be settled on key issues, such as:

  • Child custody
  • Child support
  • Property division
  • Alimony

Seeking Agreement

Nobody wants their divorce to end up in a courtroom trial, stretching the process out even longer than it already is. To that end, we:

  • Start with negotiating, working with opposing counsel to draft a divorce agreement that both parties can agree upon.
  • If negotiation does not work, we proceed to mediation, relying on a skilled mediator to help the couple reach an agreement.
  • Only if all else fails do our divorce attorneys move to the ultimate step of taking the case to court for a final adjudication by a judge or jury.

Divorce Decree

No matter whether the divorce agreement was decided between the parties or handed down by a court, the final step of the process is the court’s issuance of the divorce decree. This is the official and binding order that enforces the terms of your settlement or the judge’s ruling following a trial. The divorce is finalized once the decree is signed and filed by the court.
